Terms of sale

These terms of sale govern the sale of books, kits, games and digital files offered at a distance by Obhéa Editions in its online shop, from France, to consumer customers. Placing an order implies unreserved acceptance of these terms.

  • SIREN / SIRET: 922 205 422 / 922 205 422 00012; Créteil Trade and Companies Register no. 922 205 422
  • VAT number: FR29 922 205 422

Other legal information is in the legal notice.

2. Products

The shop offers role-playing game books and booklets (starter kits, scenarios, supplements), bundles, any derived products and their digital versions (PDF files). The main characteristics of each product (content, format, page count, print or digital version) are given on its page before ordering. Visuals are not contractual.

Products are offered while stocks last. A pre-ordered product is marked as such, with its planned shipping month shown before the order is confirmed; it is shipped as soon as it is available and the delivery times in article 6 run from that shipment: the delivery deadline is that shipping month plus the delivery time of the chosen carrier. If that date cannot be met, we will tell you and the rights described in article 6 (delivery times) apply.

3. Prices

Prices are given in euros, including all taxes (French VAT applies; for Switzerland, see article 6), excluding delivery costs. Delivery costs, calculated according to weight, chosen delivery method and country, are displayed before the order is confirmed. Books are sold at the price set by the publisher, in accordance with French Law no. 81-766 of 10 August 1981 on the price of books.

Obhéa Editions may change its prices at any time; the price that applies is the one displayed at the time of the order.

4. Ordering

  1. you choose your products and add them to the basket;
  2. you enter your details and delivery address and choose the delivery method (home or pick-up point);
  3. you check the summary (products, prices, costs, total) and can correct any mistakes;
  4. you accept these terms and confirm with the “Order with obligation to pay” button;
  5. you pay for the order; it is confirmed by a summary email.

The order is binding after payment. Obhéa Editions may refuse or cancel an order in the event of an existing dispute, failed payment, product unavailability or a manifestly incorrect address; you are informed and refunded any amount taken. The confirmation email is sent to you on a durable medium: it repeats the essential information about the order, reminds you that a right of withdrawal exists and its conditions (article 7), and refers to these terms and to the model withdrawal form. Orders concluded online are archived by Obhéa Editions, which gives you access to them on request (Article L.213-1 of the French Consumer Code).

5. Payment

Payment is made online, in euros, depending on the payment methods offered at checkout, on the secure pages of the corresponding payment provider (SumUp for bank cards, PayPal). Obhéa Editions never receives or keeps your card number. The amount is debited when the order is confirmed; for a pre-order, payment is required at the time of the order.

6. Delivery

Delivery area

Parcels are shipped from France to mainland France, Belgium, Luxembourg and Switzerland. Overseas departments, regions and territories and Monaco are not served. For any other destination, contact us before ordering; any customs duties and taxes for a country outside the European Union are payable by the recipient.

Switzerland: Switzerland is not part of the European Union. Any customs duties, VAT and local taxes payable on import into Switzerland are at your expense; they may be requested by the carrier or by customs on delivery. Please find out about them before ordering.

Carriers

  • Colissimo (La Poste): delivery to the address given, with tracking, in mainland France, Belgium, Luxembourg and Switzerland (Colissimo International, the only carrier offered for Switzerland);
  • Mondial Relay: delivery to the pick-up point of your choice, with tracking, in mainland France, Belgium and Luxembourg.

There is no collection in person. You receive an email with the tracking number when the parcel is shipped.

Delivery times

Orders are prepared within 48 hours of order confirmation (excluding pre-orders). Once the parcel has been shipped, the delivery time is 48 hours, i.e. 2 working days, for Colissimo in mainland France; for Colissimo to Belgium, Luxembourg and Switzerland, La Poste states between 3 and 15 working days depending on the destination, the service and customs formalities; it is 3 to 5 working days from the moment the parcel is collected by the carrier for Mondial Relay (mainland France, Belgium, Luxembourg). The delivery date or maximum period, preparation included, is stated before the order is confirmed and binds Obhéa Editions: we undertake to deliver the product on that date or within that period; if none is stated, the product is delivered without undue delay and no later than thirty days after the contract is concluded (Article L.216-1 of the French Consumer Code).

In the event of a delay, you may suspend payment; you may also, after asking Obhéa Editions to deliver within an additional reasonable period without result, terminate the contract by registered letter with acknowledgement of receipt or by a writing on another durable medium, and immediately if we refuse to deliver or if the delivery date was an essential condition of the contract for you (Article L.216-6). You are then refunded (Article L.216-7).

Reception

Check the parcel on receipt. If the parcel is open or damaged, or the product is damaged, state precise reservations to the carrier, keep the packaging and notify us within three working days through the Contact page, with photos. These formalities do not deprive you of your legal warranties (article 8). For a pick-up point, the parcel is kept for the period stated in the carrier’s notice; an uncollected parcel returns to the sender and the order may be refunded, delivery costs excluded.

The risk of loss of or damage to the product passes to you when you, or a third party you have designated other than the carrier, take physical possession of it (Article L.216-2). For digital products, see article 9.

7. Right of withdrawal

You have fourteen days from receipt of the product (from receipt of the last product if an order is delivered in several parcels) to withdraw without giving a reason and without penalty (Articles L.221-18 et seq. of the French Consumer Code).

  • How: notify us of your decision through the Contact page or by email to the address given in article 1, clearly, stating your order; you can use the model form below.
  • Return: send the product back without undue delay and no later than fourteen days after your notification, to the return address shown on the shipping label of your parcel (the original dispatch address, the same for Colissimo and Mondial Relay); if in doubt or if you have lost the label, ask for it through the Contact page. The product must be in its original condition and with its packaging. You only bear the direct cost of returning the product.
  • Refund: we refund all sums paid, including standard delivery costs, without undue delay and no later than fourteen days from the date on which we are informed of your decision, using the same payment method. We may defer the refund until we have received the product or until you have provided proof of its dispatch, whichever is earlier. Any extra costs resulting from your choice of a delivery method more expensive than the standard one we offer are not refunded (Article L.221-24).
  • Damaged product: you are liable only for any reduction in the product’s value resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.

The right of withdrawal does not apply to digital content not supplied on a physical medium (PDF files, ZIP archives) once performance of the contract has begun: you have given your prior express agreement to immediate performance, you have acknowledged that you thereby lose your right of withdrawal, and we have confirmed your agreement (Article L.221-28, 13°). You give your agreement and waiver by ticking a box in the order summary, before payment and download; the confirmation is sent to you by email and repeated on the invoice.

Model withdrawal form

“To Obhéa Editions (address: article 1): I hereby give notice that I withdraw from my contract for the sale of the goods below. Ordered on: … ; received on: … ; order number: … ; product(s): … ; name of consumer: … ; address of consumer: … ; date: … ; signature of consumer (only if this form is notified on paper).”

8. Warranties

Obhéa Editions is bound by the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

  • Conformity: we are liable for lack-of-conformity defects that exist at the time of delivery and appear within the following two years (Articles L.217-3 and L.217-7). For twenty-four months (twelve months for second-hand goods) you do not have to prove that the defect existed at delivery. You may ask for repair or replacement of the goods, free of charge, within thirty days at most (Articles L.217-8 to L.217-11); failing that, a price reduction or termination of the contract (Article L.217-14).
  • Hidden defects: you may act within two years of discovering the defect, choosing between cancelling the sale and a price reduction.

For digital content (PDF files, ZIP archives), you benefit from the legal guarantee of conformity of digital content (Articles L.224-25-12 et seq. of the French Consumer Code): we are liable for lack-of-conformity defects that exist at the time of supply and appear within the following two years.

For any request, contact us through the Contact page, giving your order number and, if possible, attaching photos.

9. Digital products

  • The file (PDF or ZIP archive) is made available through a personal download link, in your account or by email, after payment is confirmed. The link is valid for 365 days and allows 50 downloads at most.
  • It is licensed for personal and private use, non-exclusive and non-transferable: it may not be resold, publicly shared or put online without permission. A watermark or personalised mark may appear on it.
  • Supply of the file is considered complete as soon as it is made available. If the download fails for a technical reason, we supply it again.
  • Functionality and compatibility: a PDF file opens with any common PDF reader, a ZIP archive with decompression software; no particular software needs to be installed.

10. Intellectual property

The games, texts, illustrations, trademarks and logos sold or presented remain the property of Obhéa Editions and of their authors and illustrators. A purchase gives the right to use the product, not to reproduce it or exploit it commercially.

11. Personal data

The data collected to process your order is used to fulfil, deliver and invoice it, and is passed only to the providers required (payment, carriers). Your phone number is only used for delivery: without your prior consent, no commercial call is made to you (Article L.223-2 of the French Consumer Code). See the privacy policy.

12. Liability and force majeure

Obhéa Editions is not liable for non-performance of the contract in cases of force majeure (an unforeseeable, irresistible and external event: transport strike, disaster, general network failure…) or for acts attributable to you or to a third party. Game products are works of fiction intended for the audience stated on their page. Nothing in these terms limits your rights as a consumer.

13. Complaints

For any complaint, write to us through the Contact page or by email to the address given in article 1, stating your order number. We reply as soon as possible. You remain free to bring the matter before the competent court (article 14).

14. Governing law and disputes

These terms are governed by French law. In the event of a dispute and failing an amicable agreement, the competent court is determined under ordinary law, subject to the consumer-protective provisions that allow the consumer in particular to bring the case before the court of their home or of the place of delivery. If you live in Belgium or Luxembourg, the choice of French law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008). If you live in Switzerland, the mandatory consumer-protection provisions of your country of residence remain applicable to the extent provided by law.

15. Changes to the terms

Obhéa Editions may change these terms; those applying to an order are those in force on the date of that order. A version is kept and can be sent to you on request.
